Our terms for booking, stay and cancellation — based on the Austrian AGBH 2006, but in our own words and tailored to holiday homes.

Scope

These terms govern the contract for renting our holiday accommodation. The key points are also shown during booking: total price, down payment, cancellation scale.

§ 1 Scope

1.1 These terms apply to the rental of the holiday accommodation of Wilderer Chalets Tirol GmbH, Am Anger 14, 6100 Mösern, Austria, FN 496361v (Regional Court of Innsbruck), VAT ATU 73539646 (“we”): Wilderer Chalets (Chalet Rothirsch, Chalet Gamsbock, Chalet Steinadler) and Landhaus Moritz in Leutasch, and Wilderer Nest in Mösern.

1.2 They are based on the Austrian General Terms and Conditions for the Hotel Industry (AGBH 2006) but deviate from them in several points and are our own terms. The AGBH 2006 do not apply in addition.

1.3 Individual agreements made in writing (including by email) take precedence over these terms.

§ 2 Definitions

2.1 A guest is any person staying overnight in the accommodation. The contracting party is the person who makes the booking; they are usually also a guest. Consumer and business are to be understood as defined in the Austrian Consumer Protection Act.

2.2 The unit is the specific accommodation booked (e.g. Chalet Steinadler).

§ 3 Conclusion of contract

3.1 Online booking: by clicking “Book with payment obligation” the contracting party makes a binding offer. The contract is concluded as soon as we confirm the booking; we send the confirmation by email immediately.

3.2 Enquiry by email or phone: the contract is concluded with our written confirmation.

3.3 The unit booked is the one named in the confirmation, for the stated period and the stated number of people and dogs.

3.4 The contract languages are German and English.

§ 4 Prices

4.1 The total price shown in the booking includes accommodation, final cleaning, bed linen and towels, the local tax and — if registered — the dog fee, as well as statutory VAT. We charge no booking fee and no deposit against damage.

4.2 The local tax is a statutory levy. Children are exempt until the end of the calendar year in which they turn 15. If the statutory local tax changes after booking, we charge the changed amount.

4.3 Additional services booked are shown separately in the booking.

§ 5 Payment

5.1 Down payment: 40 % of the total price, due within 7 days of the booking confirmation via the payment link provided.

5.2 Balance: due 30 days before arrival. For bookings made less than 30 days before arrival, the total price is due immediately.

5.3 Payment methods: bank transfer, credit or debit card, Apple Pay, Google Pay, Klarna. We charge no surcharge for any payment method.

5.4 If the contracting party does not pay the down payment or the balance on time, we set a grace period of 7 days by email. If this also expires, we may withdraw from the contract; the cancellation fees in § 7 then apply.

§ 6 No right of withdrawal under distance-selling law

For accommodation contracts for a specific date there is no statutory right of withdrawal (no 14-day period) under § 18(1)(10) of the Austrian Distance and Off-Premises Contracts Act (FAGG). The cancellation terms in § 7 apply.

§ 7 Cancellation by the contracting party

7.1 Cancellation is possible at any time by email to servus@wilderer.tirol. The time of receipt by us is decisive.

7.2 The scale in the table at the end of this section applies to the cancellable rate.

7.3 Non-refundable rate: whoever chooses it when booking receives the price advantage shown there. The total price is then owed in full (100 %) from booking; free cancellation is not possible.

7.4 Instead of cancelling, the contracting party may name a substitute who takes over the contract. No fees apply.

7.5 If we manage to re-let the unit for the cancelled period, we credit the income against the cancellation fee.

7.6 We recommend travel cancellation insurance.

§ 8 Obstacles to arrival

8.1 If the guest cannot arrive on the day of arrival because all means of arrival are impossible due to unforeseeable extraordinary circumstances (e.g. extreme snowfall, flooding, closed access road), no payment is owed for the days affected.

8.2 The obligation to pay resumes from the day on which arrival is possible, provided this is the case within three days.

§ 9 Withdrawal by us, substitute

9.1 We may withdraw from the contract only in case of non-payment under § 5.4, or if the unit becomes unusable due to circumstances for which we are not responsible (e.g. natural events, official closure). In the latter case we refund all payments made in full.

9.2 We offer other accommodation only as an option. The contracting party may decline it and then receives all payments back; we bear any additional costs of accepted substitute accommodation.

§ 10 Arrival and departure

10.1 Arrival from 4 pm, departure by 12 noon, unless agreed otherwise.

10.2 Please let us know in advance if you will arrive later.

10.3 If the guest has not arrived by 12 noon on the following day without notice, this counts as a no-show (§ 7.2).

10.4 If the unit is not vacated by 12 noon, we may charge a further day if this makes the handover to the next guests impossible.

§ 11 Occupancy, dogs, house rules

11.1 The unit may be occupied by no more than the number of people booked. Children and infants count.

11.2 Dogs are allowed only if registered with the booking; the dog fee is included in the total price. The owner supervises the dog and is liable under the law for damage it causes (§ 1320 ABGB); pet liability insurance is recommended.

11.3 Our house rules apply. They are published on this website under “House rules” and are displayed in every accommodation.

§ 12 Guest obligations, damage

12.1 The guest treats the unit and its furnishings with care and reports damage without delay.

12.2 The contracting party is liable under statutory provisions for damage culpably caused by them, fellow guests or their dogs.

§ 13 Our liability

13.1 We are liable in accordance with statutory provisions. §§ 970 et seq. ABGB apply to items brought in.

13.2 Towards businesses our liability for slight negligence is excluded; this does not apply to personal injury.

§ 14 Early departure

14.1 If the guest leaves early, the agreed price remains owed.

14.2 We credit what we save through the early departure or earn by re-letting the unit.

§ 15 Extension

15.1 There is no entitlement to an extension. We agree if the unit is free.

15.2 If departure is impossible due to unforeseeable extraordinary circumstances, the contract is extended for that period at the agreed daily rate.

§ 16 Applicable law, place of jurisdiction

16.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

16.2 If the contracting party is a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected.

16.3 Claims against consumers resident in Austria may only be brought at their place of residence, habitual abode or employment; for consumers in the EU, Iceland, Norway and Switzerland, the court at their place of residence has jurisdiction.

16.4 Towards businesses, the competent court in Innsbruck has jurisdiction.

§ 17 Dispute resolution

We try to resolve any concerns directly: +43 664 147 91 23, servus@wilderer.tirol. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 18 Final provisions

18.1 Declarations may be made by email.

18.2 Where these terms do not regulate something or a provision is invalid, the statutory provisions apply.
